D.A. sounds alarm about dangers of renting out backyard swimming pools on Staten Island [Video]

STATEN ISLAND, N.Y. — Home rentals. Car rentals. Pool rentals?

Apps such as “Swimply” allow individuals looking to make some money to rent out their private swimming pools to total strangers. However, District Attorney Michael E. McMahon is reminding residents that partaking in such activity is not only potentially dangerous, but it could be illegal in New York.

McMahon’s office cites New York State Sanitary Code’s 10 NYCRR §6-1.1 which reads in part: “The purpose of this Subpart is to assure a sanitary, healthful and safe environment for the public when using swimming pools.” Additionally, it is noted that “the requirements of this Subpart shall apply to all swimming pools except those “owned and/or maintained by an individual for the use of his family and friends.”

That being said, McMahon notes that the rentals of private pools to strangers is illegal if not in compliance with the New York State Sanitary Code. Such code requires that public pools be built with …
