BUFFALO, N.Y. — A 47-year-old Buffalo man was charged with one count of rape in the first degree and one count of sexual misconduct, the Erie County District Attorney’s Office said Friday.
Joseph Folvarcik, who was working as an independent taxi driver, drove the victim from an Orchard Park bar to his Buffalo home on Jan. 21. The victim was intoxicated and physically helpless, the Erie County District Attorney Office’s said in a statement.
The defendant is accused to have had sexual intercourse with the victim, who was unable to consent. The two individuals were unknown to each other.
A temporary order of protection for the victim was issued, and Folvarcik faces up to 25 years in prison, the District Attorney Office’s said.
