The dye has been permissible for use in food, beverages and ingested drugs even though the Delaney Clause of the Federal Food, Drug and Cosmetic Act “prohibits the FDA from approving a color additive that is ingested if it causes cancer in animals or humans when ingested.”The dye was found to cause cancer in rats more than 30 years ago.
